Post 134 Queen of Hearts Rules

The Morton Grove Post #134 Queen of Hearts Raffle is being conducted by Morton Grove Post #134 (Post #134), a not-for-profit 501C(c) (19) organization pursuant to Illinois raffle act, 230 ILCS 15/0.01 et seq, and the Morton Grove municipal code. All proceeds raised by the raffle will benefit Post #134 in fulfilment of its charitable missions. The Raffle Official Rules and Regulations (“Official Rules”) are set forth below. By purchasing a Raffle ticket (“Ticket”), the purchasers acknowledge that they are aware of and agree to be bound by these Official Rules as interpreted by Post #134. Post #134 is solely responsible for interpretating and applying the Official Rules. Post #134 interpretation and applications of such rules shall be final.

 

TICKET SALES

  1. Participants must be at least 21 years old to play and do not need to be present to win.

  2. Tickets may be purchased at Morton Grove Post #134 ONLY. No mail, phone orders or internet sales are allowed, and all sales of tickets are final. All Tickets purchased for the weekly drawing must be paid for and submitted to the bin no later than fifteen (15) minutes prior to the weekly drawing time.

  3. Ticket prices are $5.00 each, and participants can buy as many tickets as they want subject to availability. Tickets must be paid for in cash.

  4. On each Ticket the participant writes his/her full name (to match driver’s license or valid ID) and phone number along with a number between 1-54.

  5. Entries which are illegible, have or appear to be altered are void. All contact information shall be legible on the Ticket. Only one person’s name may be written on Ticket. If a Ticket is pulled with more than one name it, then the name listed first will be deemed as the holder of the record of the Ticket and declared the winner. The division of any prize among a group of people purchasing a Ticket shall be the sole responsibility of the person named as the hold of the record of that Ticket should that Ticket be selected as a winner. Post #134 is not responsible for resolving any disputes that may arise from different individuals listed on a winning Ticket. Neither Post #134 nor its officers, employees, agents or other representatives assume any responsibility or liability for lost, late, misdirected, mutilated, incomplete, illegible or undelivered Tickets, or any other failure to receive Tickets, or any failure to deliver a ticket prior to the drawing deadlines.

RAFFLE BOARD AND DRAWING

  1. All 54 cards (including two jokers) are placed randomly behind 54 numbers on a factory sealed board. The board is always kept in a locked case except during weekly drawings.

  2. Tickets are placed in a bin.

  3. Unless notified otherwise on Post #134 website, weekly drawings are held at 8:00 p.m. every Tuesday at Morton Grove Post #134, 6144 Dempster Street, Morton Grove IL 60053. Drawings will always be in public.

  4. At the time of the drawing one ticket will be pulled from the bin.

  5. The name and number on the Ticket is read, and then the corresponding numbered card from the raffle board is revealed.

  6. If a number is not listed on the Ticket or if a number selected in a previous Raffle is listed on the Ticket, the Ticket shall be deemed invalid and a new Ticket shall be drawn.

  7. If the revealed card is not the Queen of Hearts, the holder of the Ticket wins $50.00. If the revealed card is one of the other Queens, the holder of the Ticket will receive an additional $50.00. If the revealed card is a Joker, then the holder of the Ticket will receive an additional $100.00. If the holder of the Ticket is not present, the totals winnings are one half. The pot continues to roll over each week until the Queen of Hearts is revealed.

  8. If the revealed card is the Queen of Hearts, the pot is divided as follows:

  9. First the expenses of the raffle (including without limitation the costs to purchase boards, bins and supplies, print Tickets and advertise the raffle) will be deducted. The remainder of the pot is the “Net Pot”.

  10. The holder of the record of the Ticket wins 50% of the Net Pot or $1,000 which ever is greater, provided that the holder of recorded Ticket is present the time of the drawing. If not present at the time of the drawing the holder of the recorded Ticket wins 25% of the Net Pot or $500.00 which ever is greater.

  11.  Post #134 receives 40% of the Net Pot and 10% of the Net Pot shall be used to start the pot for the next raffle provided Post #134 chooses to continue the raffle, otherwise said 10% shall be retained by Post #134.

  12. Each week after the drawing, all purchased Tickets, except for the winning Tickets will be destroyed and new Tickets will be sold for the next weekly drawing.

CLAIMING A PRIZE

  1. The card number and the name of the holder of record of the winning Ticket (“the Potential Winner”) shall be announced at the drawing and shall be posted on Post #134 website and or Facebook page. Post #134 shall attempt to contact the Potential Winner by calling the phone numbers on the Ticket if not present at the time of the drawing.

  2. The Potential Winner must claim his/her prize within 30 days of the drawing. If the Potential Winner does not claim his/her prize within 30 days of the drawing or if the prize cannot be awarded for any other reason, the prize shall be forfeited and become the property of Post #134. Post #134 will have the sole discretion to determine whether the Potential Winner is eligible to be the winner of the prize in accordance with these Official Rules (the Official Winner”). As a condition of his/ her right to collect a Prize and become an Official Winner, the Potential Winner must deliver to Post #134: (a) the Ticket receipt and/or proof of identity in forms satisfactory to Post #134 showing that the person claiming the prize is the holder of the record of the winning Ticket; (b) such written information as is required by any applicable tax and/or other laws, including, without limitation, Social Security Numbers; (c) if required by law, a completed IRS Form W-2G, Illinois Form 5754 or similar tax form (provided by Post #134) for tax withholding purposes which must be completed and received by Post #134 before the prize shall be paid.

  3. Non-Deductibility of Ticket Purchase: The IRS has taken the position that the amounts paid for chances in raffles, lotteries or similar drawings for the valuable prizes are not gifts, and consequentially, the purchase of a Ticket does not qualify as a deductible charitable contribution.

  4. All winners are solely responsible for the payment of any and all taxes. The Official Winner may be required to pay withholding tax in an amount required by the IRS regulations and IDOR.

  5. Post #134 shall withhold a portion of the prize as required by the IRS, federal and state law.

  6. Prize amounts will be paid by check.

 

TERMS AND CONDITIONS

Post #134 reserves the right to amend these Official Rules upon ten (10) days’ notice provided pursuant to an update provided on Post #134 website or otherwise posted at the event location. These Official Rules cannot be changed by any oral statement made by any person acting on behalf of Post #134. By entering Raffle, each Raffle participant accepts and agrees that Post #134 may use the Raffle Participants name, photograph, likeness, statements or voice for promotional or advertising purposes in all forms of media, now or hereafter known, in perpetuity, without review, permission or further compensation except prohibited by law.

 

CANCELLATION/TERMINIATION OF RAFFLE

 

By purchasing a Ticket and choosing to participate in the Raffle, each Raffle participant acknowledges and agrees that Post #134 has the right, in its sole discretion, to elect not to proceed with the Raffle for any reason whatsoever or for no reason. In such event Post #134 will conduct one final drawing in which Tickets will be drawn until the Queen of Hearts location is determined on the board.
